Did You Know? Headphones and Bike Riding
Did you know that it’s against Florida law to listen to headphones while you’re riding your bike?
Florida Statute §316.304 states, “No person shall operate a vehicle while wearing a headset, headphone, or other listening device, other than a hearing aid or instrument for the improvement of defective human hearing.” Since a bicycle is classified as a vehicle, it’s illegal (and dangerous) to use headphones while riding.
Headphones not only add their own sound, but they also help block other noises. That’s good when you’re trying to listen to music or a podcast, but it’s dangerous when you need to know if there is a car or truck trying to share the road with you.
If you’re in an accident or hit by another vehicle while riding your bike, then the user of headphones could be used as evidence of comparative negligence if an accident happens.
