Domestic violence is abuse that is sustained in an intimate relationship. The abuse doesn’t have to be physical necessarily; it can be stalking, intimidation, isolating a partner from others, withholding money, and emotional abuse. The process begins when someone files a petition for an injunction for protection against domestic violence with the clerk of the circuit court. This can be filed in the county where the filer currently lives, the county where the accused lives, or the county where the domestic violence occurred. By filing the petition, the petitioner asks the court to issue a protective order. There are different types of protective orders. A temporary injunction is commonly issued by a Judge in emergencies and protects for fifteen (15) days. To have an injunction for longer than fifteen (15) days, the Judge must schedule a hearing to allow both parties to present their side of the story.
