VA Ratings for Emphysema Veterans Disability Benefits

What Is Emphysema and How Does It Affect Veterans?

Emphysema is a form of chronic obstructive pulmonary disease (COPD) that damages the lungs. It reduces the ability to breathe and causes shortness of breath, chronic cough, and fatigue. Many Veterans develop emphysema due to exposure to harmful chemicals, burn pits, and smoking during service.

How the VA Rates Emphysema

The VA rating system determines the level of disability compensation based on lung function tests. Emphysema falls under 38 CFR § 4.97 (Diagnostic Code 6603). The rating depends on pulmonary function test (PFT) results, including:

  • Forced Expiratory Volume in One Second (FEV-1)
  • Forced Vital Capacity (FVC)
  • Diffusion Capacity of the Lung for Carbon Monoxide (DLCO)

The VA disability rating for emphysema ranges from 10% to 100%, based on test results:

  • 10% Rating – FEV-1 between 71% and 80% predicted, or DLCO between 66% and 80%.
  • 30% Rating – FEV-1 between 56% and 70%, or DLCO between 56% and 65%.
  • 60% Rating – FEV-1 between 40% and 55%, or DLCO between 40% and 55%.
  • 100% Rating – FEV-1 below 40%, DLCO below 40%, or if the Veteran requires oxygen therapy.

Common Issues Veterans Face When Applying for VA Benefits

Many Veterans struggle to get a fair VA rating for emphysema. The VA may:

  • Underrate the severity of the condition.
  • Deny the claim due to lack of evidence.
  • Fail to recognize service connection.

Veterans must provide strong medical records, doctor statements, and service history to support their claims. Buddy statements from fellow service members can also help.

How to Appeal a Denied VA Claim for Emphysema

If the VA denies a claim or gives a low rating, Veterans can appeal the decision. The best steps to take include:

  1. Request a Higher-Level Review – Ask a senior VA reviewer to reevaluate the claim.
  2. File a Supplemental Claim – Submit new evidence to strengthen the case.
  3. Take the Case to the Board of Veterans’ Appeals (BVA) – Request a hearing before a Veterans Law Judge.
